Terms of service
Effective [EFFECTIVE DATE]. Version 1.0.
These terms are an agreement between you and RosterBuddy ("we", "us"), the operator of the RosterBuddy service, contactable at [email protected]. They govern your use of the RosterBuddy website at rosterbuddy.app, the RosterBuddy mobile and web applications, and any related services (together, the "Service").
By creating an account or using the Service you agree to these terms and to our Privacy policy. If you do not agree, do not use the Service.
We have written these terms in plain language on purpose. Where a heading is followed by a short summary in a box, the summary is there to help you read; the full text underneath is what applies.
1. RosterBuddy is independent of every airline
RosterBuddy is not your airline, not part of your airline, and not acting for your airline.
RosterBuddy is an independent application. We are not affiliated with, partnered with, endorsed by, sponsored by, or otherwise connected to any airline, aircraft operator, crew-management company or aviation authority, and we are not a certified, approved or authorised application of any airline, unless we explicitly state otherwise in writing for a named airline.
Any airline names, airport codes, fleet types, route designations or roster formats that appear in the Service appear only because you or other members entered them to describe your duties. They are used for identification and are the property of their respective owners. Their appearance does not mean that airline has reviewed, approved or is aware of the Service.
Nothing you do in the Service changes your roster, your employment, or your obligations to your employer. A trade agreed in RosterBuddy takes effect on your real roster only when it is made in your airline's own system, by you and the other member, and only if your airline allows it.
2. Who can use RosterBuddy
You may use the Service only if you:
- are at least 18 years old;
- are currently employed or engaged as operating crew (cabin crew, flight crew or similar rostered aviation staff) by an airline or aircraft operator, or are a person we have expressly admitted for another reason, such as a crew association administrator;
- are not barred from using the Service under the laws of the country you are in; and
- have not previously had a RosterBuddy account suspended or closed for breaching these terms.
We may ask you to verify your crew status, for example with a staff ID, a redacted roster, or a work email address. If you can no longer meet these conditions, you must stop using the Service and may ask us to close your account.
3. Your account
You are responsible for everything that happens under your account. Keep your login details private, use a strong password, and tell us straight away at [email protected] if you think someone else has used your account. One person, one account; you may not share an account or let anyone else log in as you.
The information you give us must be accurate and kept up to date, in particular your employer, base, staff number, aircraft qualifications and roster. The Service decides who can see and take a duty from that information, and giving false information can cause another member to agree to a trade that cannot be carried out.
4. What the Service does, and what it does not do
We help you find a crew member who can take your duty, or whose duty you can take, and agree terms with them. We do not make the change on your roster.
RosterBuddy is a marketplace and coordination service. It lets you record your own roster, offer a duty to be swapped for another member's duty or covered by another member, with or without an incentive, and shows that offer only to members the Service's checks find eligible to take it. It lets members propose, counter, accept, decline and cancel terms, keeps a record of each version of the agreed terms, and lets each of you record when you have made the change in your airline's system and confirm that it is done. When both of you confirm, the duties change hands in your RosterBuddy rosters.
RosterBuddy does not:
- connect to, read from, or write to any airline's rostering, crew-management or scheduling system;
- make, submit or approve roster changes on your behalf;
- guarantee that anyone will take a duty you offer, that any member will honour agreed terms, or that your airline will allow a trade;
- confirm that a trade complies with your airline's rules, your collective agreement, flight-time limitation regulations, or any other legal or contractual requirement. The checks in the Service (for example clashing duties, rest between duties and aircraft qualifications) use the information members enter and rules we set, such as a minimum rest period; they are an aid to you, not a legal determination;
- hold, move or guarantee any incentive payment between members (section 6);
- provide employment, legal, tax or regulatory advice.
Features may change, and we may add, alter or withdraw parts of the Service. If we withdraw a feature you have paid for, section 10 explains your refund rights.
5. Your responsibilities when swapping
You agree that you will:
- follow your airline's swap policy, your employment contract, your collective or enterprise agreement, and all applicable laws and regulations, including flight-time limitation and fatigue-management rules, when deciding whether to offer, accept or carry out a trade;
- make every agreed change through your airline's own system or process, and treat terms agreed in RosterBuddy as agreed-in-principle until the change is made there;
- only offer duties that are actually on your roster and that you are permitted to trade;
- honour terms you have accepted, by making the change promptly and confirming it in the Service, and not withdrawing without telling the other member, except where your airline does not allow it or circumstances outside your control make it impossible;
- record your duties accurately, including report and release times and the aircraft;
- only confirm a step, such as making the roster change or sending or receiving an incentive, when it has actually happened;
- treat other members with courtesy.
You are solely responsible for the consequences of any trade you make, including disciplinary, contractual or regulatory consequences if a trade turns out to be against your airline's rules or the law.
6. Incentives and payments between members
You can offer an incentive for a trade. It is paid directly between members by bank transfer (PayNow for Singapore); RosterBuddy does not hold the money and charges no fee for it.
When you offer a duty you may attach an incentive: a fixed amount, or an amount the other member proposes and you accept. The member who offers the duty always pays any incentive. Amounts are in Singapore dollars and become part of the agreed terms.
Incentives are paid by bank transfer, directly from the paying member to the receiving member. In Singapore this is PayNow: to receive an incentive, you add a Singapore PayNow mobile number to your profile. It is shown only to the member who owes you, and only after both of you have confirmed the roster change. The paying member pays the agreed amount promptly and marks it sent in the Service; the receiving member marks it received once it arrives.
RosterBuddy does not receive, hold, transfer or refund these payments, cannot see bank transfers, and charges no fee for them. "Sent" and "received" are each member's own confirmation. If a payment does not arrive or is disputed, either member can raise a dispute in the Service; a moderator can review the agreed terms and the steps each of you recorded, but cannot recover money.
You are responsible for making sure an incentive is permitted by your airline's policies and your contract, and for any tax that applies to money you pay or receive.
If we later offer to handle incentive payments through a payment provider, we will describe how it works and any fee before you agree terms that use it, and the provider's own terms will also apply.
7. Conduct we do not allow
In addition to the rules above, you may not:
- offer duties that are not yours, that are fabricated, or that you have no intention of trading;
- agree an incentive you do not intend to pay, or mark a payment sent or received when it was not;
- use the Service to harass, threaten, discriminate against, defame or intimidate anyone, or to coordinate industrial action in breach of applicable law;
- collect, scrape, copy or export other members' duties, profile details or payment details, by hand or by automated means, for any purpose outside arranging a trade with that member;
- impersonate another person, an airline, a union or a regulator;
- upload malicious code, probe or circumvent our security, or interfere with the Service's operation or other members' use of it;
- use the Service for any commercial purpose other than those we offer (for example, reselling access to the Service or running a swap-brokering business through it); incentives between members for their own duties, as section 6 describes, are allowed;
- enter content that is unlawful, infringes anyone's rights, or that discloses confidential operational information about an airline, its passengers, or security arrangements beyond what is necessary to describe a duty.
8. Your content and your roster
You own the content you put into the Service, including your roster, listings, the terms you propose and your profile. You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process and display that content for the purpose of operating and securing the Service, and to show the parts of it that are needed to arrange a trade to the members who can take it or have agreed it with you. This licence ends when you delete the content or close your account, except for copies kept in routine backups for a limited time, records we must keep by law, and duties and terms that are part of another member's trade history, which are kept without your name as the Privacy policy explains.
Your roster and the personal information in it are also governed by our Privacy policy, which explains what we collect, why, who sees it, how long we keep it and the rights you have under the data protection laws of Singapore, the European Union and United Kingdom, Australia, Indonesia and the Philippines.
You enter your roster yourself, duty by duty. You are responsible for making sure you are permitted to record it in the Service; if your employer's policies restrict sharing roster information, it is your responsibility to comply with them, for example by entering only the duties you wish to trade and those either side of them.
We may remove content that breaches these terms, and will tell you why unless the law prevents us.
9. Our content
The Service, including its software, design, text, logos and the RosterBuddy name and rings mark, is owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the Service as these terms allow. You may not copy, modify, reverse-engineer, resell or create derivative works from the Service except where the law gives you a right we cannot exclude. Feedback you give us about the Service may be used by us without obligation to you.
10. Beta, and any future paid plans
RosterBuddy is in beta and free. Features may change, and we charge nothing. Incentives you agree with other members are paid between you, not to us.
The Service is currently offered as a beta release. During the beta it is free of charge, features may be added, changed or removed as we learn from members, and interruptions or defects are more likely than in a finished product. Because nothing is charged, section 13 limits our liability for free use.
We may introduce optional paid plans after the beta. If we do, offering duties, proposing and agreeing trades, and confirming them will remain free; we will describe any paid plan on our pricing page before it is available; and the following terms will apply to it:
- Price and tax. Prices are shown in the currency applicable to your store or region and include any taxes we are required to collect unless stated otherwise.
- Renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. We will tell you at least 30 days in advance of any price increase; if you do not agree with it, cancel before it takes effect.
- Cancelling. You can cancel at any time in the app, or through the app store you subscribed through. Cancellation takes effect at the end of the current paid period and you keep paid features until then.
- Trials. If a trial is offered, we will tell you its length and the price you will be charged when it ends. You can cancel during the trial and will not be charged.
- Refunds. Subscriptions bought through Apple's App Store or Google Play are refunded under that store's rules. For subscriptions bought directly from us, we refund if we withdraw a paid feature you relied on, if the Service is materially unavailable for an extended period, or where the law requires it. Nothing in this section limits rights you have under consumer law that cannot be excluded, including under the Australian Consumer Law, Singapore's Consumer Protection (Fair Trading) Act, Indonesia's Consumer Protection Law and the Philippine Consumer Act.
- Group plans. If a plan is purchased by an organisation such as a crew association for its members, that organisation is responsible for payment and for telling its members. We never give such an administrator access to an individual member's roster, listings or trades.
11. Suspending or closing accounts
You may delete your account at any time in the app, under Profile, Delete account, once any agreed or disputed trade is finished. We may suspend or close your account, remove content, or restrict features if you breach these terms, if we reasonably believe your use creates a risk to other members or to us, if you no longer meet the eligibility conditions, or if we are required to by law. For serious breaches, such as fabricating duties, not paying an incentive you agreed, or harassing a member, we may do so immediately and permanently. Otherwise we will try to tell you first and give you a chance to fix the problem.
When an account closes, your open listings are closed and your pending proposals are cancelled. Your data is handled as the Privacy policy describes.
12. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the extent the law allows, we do not promise that the Service will be uninterrupted, error-free or secure, that anyone will take a duty you offer, that members will honour agreed terms or pay agreed incentives, that the Service's checks will catch every legal or contractual limit, or that any airline will allow a trade. Information in the Service about duties, rest, days off, qualifications and payments comes from members, and the checks apply rules we set; we do not verify any of it against airline, bank or regulatory sources.
13. Liability
We are responsible for the Service we provide. We are not responsible for what your airline decides, or for what another member does.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under consumer guarantees that apply to you (for example, under the Australian Consumer Law, where our liability for a failure of a guarantee is limited, where the law permits, to resupplying the service or paying the cost of having it resupplied).
Subject to that, we are not liable for: loss or damage arising from the actions or omissions of other members, including a member failing to honour agreed terms or to pay an agreed incentive; any decision by an airline to approve, decline, reverse or discipline in connection with a swap; loss of earnings, allowances, leave or benefits; loss of or inaccuracy in roster information you entered; any payment made or not made between members; or any indirect or consequential loss. For paid plans, our total liability to you in any 12-month period is limited to the amount you paid us in that period; for free use, to SGD 100 or the equivalent in your currency.
14. Your responsibility to us
You will compensate us for losses, costs and reasonable legal fees we incur as a result of your breach of sections 5, 6 or 7, or of a claim by a third party (including your airline or another member) arising from content you posted or a swap you arranged, except to the extent we caused the loss.
15. Changes to these terms
We may change these terms. For changes that reduce your rights or add obligations, we will give you at least 30 days' notice by email and in the app before they take effect, and you can close your account before then without penalty. Continuing to use the Service after a change takes effect means you accept it. Minor changes, such as clarifications or new features that do not affect your rights, may take effect when published, with the version number and effective date updated at the top of this page.
16. Governing law and disputes
These terms are governed by the laws of [GOVERNING LAW JURISDICTION], and the courts of [JURISDICTION] have non-exclusive jurisdiction over disputes arising from them. If you are a consumer living in a country whose laws give you the right to bring claims in your local courts or to rely on your local consumer-protection laws, nothing here takes those rights away, and a court in Singapore, the European Union, the United Kingdom, Australia, Indonesia or the Philippines may apply its mandatory consumer law to you.
If something goes wrong, please contact us first at [email protected]; most problems can be sorted out within a few days. Where local law provides a free dispute-resolution body (for example, the Consumers Association of Singapore, a state or territory fair-trading office in Australia, Indonesia's consumer dispute settlement body, or the Philippine Department of Trade and Industry), you may use it.
17. General
If part of these terms is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor that takes over the Service, and will tell you if we do. These terms, with the Privacy policy and any plan terms you accept when subscribing, are the whole agreement between us about the Service. Translations are provided for convenience; the English version prevails if they differ.
